IP EDUCATION

 

Intellectual Property (IP) is the intangible assets that results from the human mind and creativity. New inventions such as intelligent systems, cars, medical diagnostic systems, smart phones, smart processes of doing things; paintings, sculpturing, play, movies, music, brand names, trademarks, business policies are all forms of IP. These IPs therefore need to be protected for better commercial and non-commercial benefits from its right of ownership.

                

                              VARIOUS IP RIGHTS


The diagram shows the various IP rights, but there are more. We have Trade secrets, Geographical Indication, Appellation of Origin and many more.

Patent

Is the exclusive right granted by a Government for an invention which is a product or a process that provides in general, a new way of doing something or offers a new technical solution to a problem.

Geographical Indications (GIs)

Signs used to identify goods that have a specific geographical origin and possess qualities, a reputation or characteristics that are essentially attributable to that origin. Example Champagne drink from a town called Champagne in Europe.

Copyright 

This is the right granted to authors, composers, software developers, website designs and other creators of original and creative works such as architecture, films, novels, poetry, paintings, computer programs etc.



Trademark

This is a sign or symbol used to distinguish goods and services of one enterprise from another. Example Coca cola, Samsung, IBM, Apple, Rlg etc.

Industrial Design

This is generally the ornamented or aesthetic of a product. Example; the shape of Coca cola bottle, cars, laptops, smart phones etc. 

                    The designs can be protected




Trade Secret

This is generally information about a business or organization that is kept secret from the public and competitors because it confers some sort of economic benefit to the owner.eg Coca cola ingredients etc.

DEFENSIVE USE

  • Prevent copying by competitors
  • Increase bargaining  power in intellectual property rights litigation

OFFENSIVE USE

  • Expel competitors from the market
  • Exert your right as the exclusive owner of  that intellectual property
  • Create profit from licensing

INVESTMENT ASPECTS

  • Increase value of the company

MARKET ASPECTS

  • Increase brand recognition eg. Samsung, Apple, Motorola, Goggle, Rlg, Coca cola, Pepsi, IBM, Microsoft, Hyundai etc.
